A lawsuit has been filed  against Toyota regarding the Toyota sudden unintended  acceleration Recalls.  It is the first Class Action filed in California State Court regarding the Toyota Recalls.

“This case is different from the other cases being filed across the Country.”  San Diego Attorney William Turley explains.  “The way the case is different is it doesn’t matter if the underlying defect is a floor mat, a faulty gas pedal or a computer software glitch.  What this case concerns is the huge loss of value California  Toyota and Lexus owners face in light of the Toyota Recalls.”

“We live in California, we work in California, the people we represent are in California, so we would prefer to stay in a California state court,” said Tracee Lorens, one of the attorneys in the case.

Among other alleged violations, the plaintiffs contend that Toyota engaged in unfair or illegal business practices by failing to notify its customers about a mechanical or electrical problem that causes the cars to accelerate without the driver stepping on the gas pedal. As a result, the cars have significantly diminished resale or trade-in values.

“Each of these Toyota owners and Lexus owners has suffered economic harm due to the recalls based on sudden unintended acceleration,” attorney William Turley said.

SAN DIEGO, Calif. (CBS 8) - The first class action lawsuit against Toyota in its sudden acceleration recalls was filed in San Diego Friday, attorneys said.

The lawsuit is centered on the diminished value of Toyota and Lexus vehicles sold and owned by California residents, and not the vehicles' defects, according to attorney William Turley.

"This case is different from the other cases being filed across the country. It doesn't concern the underlying defects, such as floor mats, faulty gas pedal or a computer software glitch, but is focused on the huge loss of value California Toyota and Lexus owners face in light of the Toyota recalls," Turley said.

Turley says this case is different from others being filed across the Country that involve floor mats or faulty gas petals. He says the basis of this lawsuit is, how the massive safety recall is causing car values to drop.
